1. Introduction

These Terms of Use (“Terms”) set out the basis on which you (“you”, “your”) may access and use the Express POD website, any Express POD applications or dashboards, and any print-on-demand fulfilment and related services provided by us (together, the “Services”).

The Services are operated by Express Global Products Ltd, a company registered in England and Wales with company number 12537003, whose registered office is 11 Mortimer Road, Cubley, S36 6DE, United Kingdom (“we”, “us”, “our”).

By creating an account, connecting your store, placing orders or otherwise using our Services, you confirm that you:

  • are acting in the course of a business and not as a consumer; and
  • agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our website, app, integrations or any of our Services.

2. Our Services

Express POD provides:

  • online tools and integrations that allow you to create, publish and manage personalised or print-on-demand (“POD”) products on your own e-commerce channels (such as Shopify, Etsy, Amazon or your own website); and
  • print, packing and shipping services for orders placed for those products.

We act as a white-label fulfilment partner. We fulfil orders under your brand; your end customer contracts with you, not with us.

We may add, change or remove features, integrations, products or services from time to time. Where changes materially affect how you use the Services, we will use reasonable efforts to notify you.

3. Trading Details

When you order products or services from us, you enter into a contract with:

These Terms, together with any pricing agreements and policies referenced on our website, form the entire agreement between you and us in relation to the Services.

4. Accounts, Access and Security

To use the Services, you may need to create an account and/or connect your e-commerce store. You must ensure that all information provided is accurate and kept up to date.

You are responsible for:

  • maintaining the confidentiality of your login details;
  • restricting access to your account; and
  • all activity that takes place under your account (including orders submitted automatically via integrations).

If you believe your account has been compromised, you must notify us immediately at info@expresspod.co.uk.

We may suspend or terminate access to the Services at any time if we reasonably believe that:

  • you have breached these Terms;
  • your account is being misused;
  • you are involved in fraud, abuse or unlawful activity; or
  • it is necessary to protect our systems, our business or other users.

5. Ordering, Production and Turnaround

Orders may be submitted through our online dashboard, via connected platform integrations, or via any manual ordering method we make available.

When you or your systems confirm an order through the Services, you are:

  • instructing us to produce and ship that order on your behalf; and
  • agreeing to pay the applicable product, shipping and service charges.

Turnaround times: We typically aim to produce and dispatch orders within 1–3 working days, but this is not guaranteed and is always subject to capacity, stock availability, technical issues, third-party services and other factors.

Order Changes: Once an order has entered production, it cannot be changed or cancelled as it will already have been printed.

We reserve the right to reject or cancel an order where:

  • a product is unavailable or discontinued;
  • we cannot obtain payment authorisation;
  • there is a pricing or product configuration error;
  • the content breaches our Content Rules (see section 7); or
  • we reasonably suspect fraud, abuse or breach of these Terms.

6. Pricing, Payment and VAT

Current pricing for products, print and shipping will be shown in your account, within documentation we provide to you, or as otherwise agreed in writing.

Unless stated otherwise, prices:

  • are quoted exclusive of VAT; and
  • exclude shipping charges, which are shown separately at checkout or in your account.

VAT will be applied at the prevailing UK rate where applicable.

You agree to pay all fees, charges and taxes applicable to your use of the Services via the payment methods we support.

We may suspend fulfilment or hold shipments if any amounts owed by you are overdue.

7. Artwork, Personalisation and Content Rules

You are solely responsible for all text, images, artwork, designs and other content (“Content”) that you or your users upload, submit or generate through the Services.

You confirm that:

  • you own or have obtained all licences needed to use the Content; and
  • the Content does not infringe any copyright, trade mark, design right or other third-party rights.

Licence to use Content: You retain all rights in your Content. By uploading or submitting Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, print, pack and ship products solely for the purpose of providing the Services.

Prohibited Content: You must not upload or submit any Content that:

  • infringes copyright, trademarks or other rights;
  • is defamatory, abusive, threatening or illegal;
  • is pornographic, sexually explicit or otherwise inappropriate;
  • promotes hatred, discrimination or violence;
  • includes personal data about another person without consent;
  • violates any applicable law; or
  • may reasonably damage our reputation.

We may refuse or cancel orders containing prohibited Content, and you agree to indemnify us against all losses arising from your breach of this section.

8. Delivery, Risk and Title

We arrange shipment of orders using carriers we make available. Charges are shown in your account or during checkout.

Dispatch date refers to when we pass the parcel to the carrier, not when it will be delivered.

Risk transfers to you when the order is handed to the carrier. Title transfers on full payment.

Delivery times are estimates only. We do not guarantee delivery dates.

We are not responsible for:

  • production or dispatch delays;
  • carrier delays or failures;
  • lost or damaged parcels;
  • incorrect delivery information supplied by you.

9. Returns, Faults and Refunds

Because products are custom-made, we do not offer refunds or returns except where an item is faulty or we have made an error.

If a product is faulty, damaged in production, or incorrect, you must notify us within 7 days of delivery to your customer with:

  • order number;
  • description of the issue;
  • photographic evidence.

If we accept that the item is faulty, we will either:

  • reprint and resend the item; or
  • issue a credit to your account.

We are not responsible for issues caused by:

  • misuse or mishandling;
  • normal wear and tear;
  • low-resolution or poor Content provided by you.

10. Use of the Website, App and Integrations

You agree not to misuse our systems, including by attempting to gain unauthorised access, introducing harmful code, scraping automated data, reverse-engineering or disrupting the Services.

All website and app content is owned by us or our licensors. You may not copy or use it except as required to use the Services.

11. Data Protection and Privacy

We process personal data in accordance with UK data protection law and our Privacy Policy.

You are responsible for ensuring you have lawful authority to share your end-customer data with us for order fulfilment.

12. Liability and Indemnity

Nothing in these Terms limits liability for death, personal injury or fraud.

We are not liable for:

  • loss of business, profit or revenue;
  • loss of data;
  • loss of goodwill;
  • indirect or consequential losses.

Our total liability is limited to the amount you paid us in the previous 12 months.

You agree to indemnify us against claims arising from:

  • your breach of these Terms;
  • Content you supply;
  • misuse of your account.

13. Changes to These Terms

We may update these Terms at any time. Updates take effect when posted. Continued use of the Services constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Both parties submit to the non-exclusive jurisdiction of the English courts.

15. Business Hours

Our standard operating hours are Monday to Friday, 9am–5pm (UK), excluding public holidays.

16. General

If any provision is held invalid, the remaining provisions remain enforceable.

No third party has rights under these Terms.

You may not assign your rights without our written consent.
